Wire Fraud

18 U.S.C. § 1343 makes it a federal crime to use a wire communication in furtherance of a scheme to defraud or to carry out a scheme to obtain money or property by means of false or fraudulent pretenses. To prove wire fraud under 18 U.S.C. § 1343 the government must show: (1) a scheme to defraud; (2) committed with intent to defraud; and (3) use of the mails to further the fraudulent scheme. The prosecutor does not have to prove that the scheme to defraud was successful. The prosecutor only has to prove that a scheme existed in which use of a wire communication was reasonably foreseeable and that an actual wire communication occurred in furtherance of the scheme.

Wire fraud is a very serious offense and is punishable by up to twenty years in federal prison.
